1. Introduction and Scope
Welcome to Cloudbase.vn (“Cloudbase”, “we”, “provider”). This Terms of Service document (“Terms”) defines the legally binding conditions between Cloudbase and individuals/organizations (“Customer”, “you”) when accessing or using any services provided by Cloudbase.
By registering an account, accessing, or using the services, you acknowledge that you have read, understood, and agreed to be bound by all contents of these Terms, along with other related policies published on the website.
If you do not agree with any content, you must immediately stop using the services.
2. Definitions
In this document, the terms are understood as follows:
+ “Service”: includes VPS, cloud compute, storage, network, and related products;
+ “Account”: user registration information used to access the system;
+ “Resources”: CPU, RAM, storage capacity, bandwidth, and other infrastructure components;
+ “Data”: all content stored, processed, or transmitted by customers through the system.
3. Service Description
Cloudbase provides a cloud computing infrastructure platform that allows customers to deploy, operate, and manage their systems.
We have the right, at any time, to:
+ Upgrade, modify, or improve services;
+ Change technical configurations to ensure performance and security;
+ Temporarily suspend part of the service for maintenance.
These changes may occur without prior notice in emergency situations.
4. Account Registration and Management
To use the services, you must create an account and:
+ Provide accurate and complete information;
+ Update information whenever changes occur.
You are fully responsible for:
+ Protecting your login information;
+ All activities arising from your account.
Cloudbase is not responsible for damages arising from:
+ Disclosure of login information;
+ Unauthorized use by third parties.
We have the right to:
+ Refuse, temporarily suspend, or terminate an account if signs of violation are detected.
5. Payment and Billing Policy
5.1 Billing Structure
Services are charged based on:
+ Usage duration (hour/day/month);
+ Actual consumed resources.
Service prices are clearly published at the time of registration.
5.2 Payment Obligations
Customers are responsible for:
+ Maintaining sufficient balance to operate services;
+ Making full and timely payments.
5.3 Service Suspension and Data Deletion
In case of non-payment:
+ Services may be automatically suspended;
+ Data may be permanently deleted and cannot be recovered.
5.4 Refund Policy
Cloudbase does not provide refunds for services that have already been used. Any exceptions (if applicable) will be decided by Cloudbase.
6. Acceptable Use Policy
Customers agree not to use the services for the following purposes:
6.1 Illegal Activities
+ Violating Vietnamese or international laws;
+ Storing or distributing prohibited content.
6.2 System Attacks and Abuse
+ DDoS, brute-force attacks, vulnerability scanning;
+ Unauthorized access to systems.
6.3 Distribution of Malicious Content
+ Malware, ransomware;
+ Spam emails, phishing.
6.4 Resource Abuse
+ Crypto mining causing overload;
+ Running botnets, proxy abuse;
+ Using excessive resources that affect the system.
6.5 Violation Handling Measures
Cloudbase has the right to:
+ Limit resources;
+ Immediately suspend services;
+ Terminate accounts without refund.
7. Resource Management and Performance
Cloudbase operates a multi-tenant environment, therefore:
+ Resources are not guaranteed to always achieve 100% theoretical performance;
+ Resource limitations may be applied to ensure fairness;
In case of activities affecting the system:
+ We have the right to intervene without prior notice.
8. Service Commitment (Uptime & SLA)
Cloudbase targets 99.9% uptime under normal conditions.
SLA does not apply in cases of:
+ Scheduled or emergency maintenance;
+ Events beyond control such as natural disasters, large-scale network failures, or provider-related issues.
Cloudbase is not responsible for compensation in these cases.
9. Backup and Data
Customers are responsible for proactively backing up their data periodically. Cloudbase does not guarantee default backup storage and is not responsible for data loss. When a service is deleted, all data will be permanently removed from the system.
10. Security and Privacy
Cloudbase commits to applying reasonable security measures to protect the system. However, we have the right to provide customer information when legally required by authorized authorities.
11. Limitation of Liability
To the maximum extent permitted by law, Cloudbase shall not be liable for:
+ Indirect or consequential damages;
+ Data loss or business interruption;
+ Lost profits.
Total liability (if any) shall not exceed the amount paid by the customer during the most recent billing period.
12. Service Suspension and Termination
Cloudbase has the right to suspend or terminate services in the following cases:
+ Violation of terms;
+ Failure to make payments;
+ Activities affecting the system.
Customers may stop using the services at any time.
13. Changes to Terms
Cloudbase reserves the right to update these Terms at any time. Updated versions become effective immediately upon publication. Continued use of services means acceptance of the changes.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Vietnam. Any disputes shall first be resolved through negotiation. If no agreement can be reached, disputes shall be resolved by the competent court.
